Plaintiff against M/s KAF Application and Solutions Pvt Ltd (Defendants) and their Director Mr. Alkesh Vishnushanker Thaker and Mrs. Alpana Alkesh Thaker Under section 9 of code of civil Procedure Code 1908 and as per section 55 of Sale of Goods Act for recovery of excess amount paid under Sale of Goods Act. The plaintiff had asked for quote for supply of O ring and other material, the defendants had not supplied the same and sent the bills and same were wrongly booked and during audit it was found that bills are bogus and goods for the same were never supplied and delivered by the defendants. Hence BEW filed the case / suit for the recovery of excess amount paid of Rs 15,96,612/- for which the Defendants has never delivered goods to the company. The matter is currently at the stage of evidence. On the previous date, the advocates for both sides were present before the court. The plaintiff filed an evidence affidavit, which has been marked as Exhibit 20. Additionally, an application seeking permission to file certain documents was submitted and marked as Exhibit 21. The court has now adjourned the matter to allow for submissions (say) on Exhibit 21. The previous hearing was held on 13/08/2025, and the purpose is to proceed with the evidence. The matter is pending before the Court Civil Judge Senior Division at Kalyan and next date for recording evidence of plaintiff on 14/10/2025.

Plaintiff against M/s KAF Seal INC (Defendants) and its proprietor Mrs. Alpana Alkesh Thaker Under section 9 of code of civil Procedure Code 1908 and as per section 55 of Sale of Goods Act for recovery of excess amount paid under Sale of Goods Act. Jain Proprietor DLH Stainless Vs BEW Engineering Pvt Ltd and their Director Mr. Rohan Prakash Lade for claiming interest against dishonored two cheques. The previous hearing was held on 20/06/2025. Summons was received and for recording evidence other previous hearings was held on 14/08/2025 & 26/09/2025. Summons was received and for recording evidence next hearing scheduled for 11/12/2025. The matter stay by Honble session court before trial court.
